      Illinois is an At-Fault State: This means that the law of negligence governs Illinois motorcycle and Illinois motor vehicle accidents. The person who is found to be “at fault” for the Illinois motorcycle accident can be held accountable for your injuries and damages in your Illinois motorcycle accident.
 
      Illinois Motorcycle Definition: The following statute provides the definition of an Illinois motorcycle --
815 ILCS 710/10.1
710/10.1. Motorcycles

§ 10.1. (a) … “Motorcycle” means every motor vehicle having a seat or saddle for the use of the rider and designed to travel with 3 or less wheels in contact with the ground, excluding farm, garden, and lawn equipment, and including off-highway vehicles.
      Illinois Helmet Law: When you are operating or riding on an Illinois motorcycle, you are not required by law to wear a helmet for protection. However, it is always a good idea to protect yourself and your passengers when riding an Illinois motorcycle.
 
Federal Motor Vehicle Safety Standard 218: In that Illinois does not have a helmet law, the only standards for helmets are the standards imposed on manufacturers and distributors of helmets.
 
      Illinois Motorcycle Eye Protection Law: If you are riding on or operating an Illinois motorcycle, you are required by law to wear eye protection, unless the Illinois motorcycle is equipped with a windscreen.
 
625 ILCS 5/11-1404
§ 11-1404. Special equipment for persons riding motorcycles, motor driven cycles or motorized pedalcycles.

(a) The operator of a motorcycle, motor driven cycle or motorized pedalcycle and every passenger thereon shall be protected by glasses, goggles or a transparent shield.

(b) For the purposes of this Section, glasses, goggles, and transparent shields are defined as follows:

“Glasses” means ordinary eye pieces such as spectacles or sunglasses worn before the eye, made of shatter-resistant material. Shatter-resistant material, as used in this Section, means material so manufactured, fabricated, or created that it substantially prevents shattering or flying when struck or broken.

“Goggles” means a device worn before the eyes, the predominant function of which is protecting the eyes without obstructing peripheral vision. Goggles shall provide protection from the front and sides, and may or may not form a complete seal with the face.

“Transparent shield” means a windshield attached to the front of a motorcycle that extends above the eyes when an operator is seated in the normal, upright riding position, made of shatter-resistant material, or a shatter-resistant protective face shield that covers the wearer’s eyes and face at least to a point approximately to the tip of the nose.

(c) Contact lenses are not acceptable eye protection devices.
 
      Illinois Motorcycles – Required Insurance: In Illinois, you are required by law to insure your Illinois motorcycle. The minimum insurance required for your Illinois motorcycle is compulsory liability insurance. The minimum liability limits for your Illinois motorcycle are as follows: (20/40/15)
 
•        Bodily Injury Liability (1 Person): $20,000
•        Bodily Injury Liability (All persons, 1 accident): $40,000
•        Property Damage Liability: $15,000
 
      Illinois UM (Uninsured Motorist) Coverage: If you are injured in an Illinois motorcycle accident, UM coverage – uninsured / underinsured motorist coverage – may protect you in a situation where the at-fault driver has inadequate or no insurance to cover your claims. If you are injured in an Illinois motorcycle accident by a hit-and-run driver, UM coverage may also protect you in this situation.

      Illinois Statute of Limitations: If you are injured in an Illinois motorcycle accident, and wish to commence suit as a result, you must do so within 2 years from the date of your Illinois motorcycle accident.

Sec. 13 202. Personal injury   Penalty.
“Actions for damages for an injury to the person, or for false imprisonment, or malicious prosecution, or for a statutory penalty, or for abduction, or for seduction, or for criminal conversation, except damages resulting from first degree murder or the commission of a Class X felony and the perpetrator thereof is convicted of such crime, shall be commenced within 2 years next after the cause of action accrued …”
